New Delhi: Three years after implementation of the RTI Act, many public authorities are still “reluctant” to disclose information, the Central Information Commission has said and demanded enhanced manpower for effective compliance of the Act.

Many organisations are yet to comply with Section 4, a mandatory requirement under which public authorities are liable to disclose information and make it accessible for public, Central Information Commissioner Shailesh Gandhi said.

“There is lack of commitment from public authorities. Information Commissioners across the country have not been able to ensure its implementation. Many state and Central government affiliated organisations are reluctant in abiding by Section 4,” he told PTI.

According to Section 4 of the RTI Act, public authorities shall maintain all its records duly catalogued and indexed in a manner and form which facilitate the RTI Act.

They should ensure that all records, which are appropriate to be computerised, are within a reasonable time and subject to availability of resources, computerised and connected through a network all over the country on different systems so that access too such records is facilitated.

The CIC has also written a letter to the Prime Minister’s Office in order to draw its attention towards various factors responsible for under compliance of the Act.

To make the RTI Act effective, 1. The appellate Authorities should be a higher rank official from another department, not from the same department as to that of the CPIO 2. The erring CPIO and AA should be punished with penalty and disciplinary action for non-application of mind or for following the delay and deny tactics. 3. The efficient CPIOs should be appreciated 4. Manpower should be improved at CIC and SIC. 5. All CPIOs and AAs should be communicated with latest Legal decisions and CIC decisions on popular items. 6. The HCs should be manned with adequate and sanctioned strengh of judges 7. Important decisins should be published and aired and webcast and telecast in popular TV channels and DD channels. 8. Proper training to be imparted to all CPIOs and AAs on RTI Act. 9. Continuous offending CPIOs and AAs may be taken disciplinary action. 10. An aptitude test for transperancy should be conducted before appointing a person as a CPIO or AA. 11. Preferably youth below 40 should handle CPIO or AA posts. 12. Some RTI duty allowance should be granted to all CPIOs and AAs.

I had appeared along with Sh. J S Solanki the main applicant before CIC on 22nd Sept, 2008 for getting oder passed against NBCC for withholding some information which concernded me as well . The result was that I was hounded out of Delhi and Sh. Solanki was posted at a place not conducive to his JOB profile by NBCC Management. This was the benefit of RTI. We have taken it up with Ministry of UD but to no use. We cannot take it up with PMO because the documents which are sent there are hushed up there at the behest of NBCC management by the officials .
