Mumbai: The labour ministry on Thursday said a pilots’ union at Jet Airways (India) Ltd, India’s largest private airline by passengers carried, could not go on strike as air transport is as a public utility service.

The office of the deputy labour commissioner, central, under the ministry of labour and employment, added that the newly formed National Aviators Guild (NAG) cannot go on strike while conciliation proceedings are in process.

The labour commissioner has called for talks between the union and the airline management on 31 August.

On Monday, NAG said it had served a notice to the Jet Airways management that its members would go on an indefinite strike beginning midnight of 7 September to demand the reinstatement of two pilots fired earlier in August. Sam Thomas and Balaraman were fired by Jet Airways for their roles in forming the union.

Mint could not immediately contact NAG president Girish Kaushik.

“In view of this clarification, and this confirmation by the government authorities, Jet Airways assures all its guests that, going forward, it is confident of maintaining normalcy in its flight schedules and operations,” a spokeswoman for the airline said in a statement.

It is strange that the Dy.Labour Commissioner terms the strike illegal when the reconcilliation is called for. Jetairways has terminated the services of two pilots who are office bearers of the Association and who come under the term " Protected workmen". Why didn't the Commisioner not term the termination of the two pilots as illegal ? If he wants to be fair, he should follow the law and not be biased

a company can not run efficiently if a unions start interfering in management decisions. Do management has the right to hire and fire employees are not? Going on a mass leave is not a way to protest.

Jet has taken a right step. If you don’t want to work just make a union. Already aviation industry is suffering from a bad phase and union is always increasing problem. Today a lot of industry is closed due to union. As a passenger I will request aviation ministry to cancel some of the pilot's license so that they can not fly in Indian Sky. Pilot's CL is purely illegal.

I agree with Pankaj & Suresh. At times some tough decisions are needed to be taken by such large well established companies. They can't let unions dictate terms, but instead need to be more cognizant of how their actions will affect both internal & external stakeholders, as well as the economy. I see the reason for their stance as only great companies make such bold decisions in the face of dilemma

These high paid, white collared pilots are holding the country to a hostage and causing the common man tonnes of inconvenience. I would sincerely hope that Law of land takes its course and put these pilots into jail or cancel their licenses.

Right to associate and collective bargaining is a fundamental right given to Indian under Indian constituent. Even International Labour Organization recognizes as this right as one of the core worker rights. Action taken by Jet management is autocratic.The question that Jet airways pilots are Public Utility is highly biased.I don't say that strikes are good for economy, but right to associate and collective bargain can't be compromised under any circumstances. India is a democracy and not a dictator or communist form of Government and this right is required to maintain the essence of Indian democracy.
