New Delhi:PepsiCo Inc. and Stokely-Van Camp Inc. have filed a petition in the Delhi high court against Heinz’s energy drink ‘Glucon D’ for violation of its trademark brand ‘Gatorade’.
In its petititon, Stokely urged the court to restrain Heinz from using the slogan “Rehydrates, replenishes and recharges”, which Stokely alleges is similar to its own slogan, “Rehydrate Replenish Refuel”. Further, Stokely has objected to the packaging of the ‘Glucon D’ bottle, which it claims is deceptively similar to its own product.
Heinz India Pvt. Ltd, in its reply to the petition, has claimed that the registration of Stokely’s trademark is invalid and the slogan used is only a description of its product.
PepsiCo’s spokesperson declined comment since the matter was sub judice.
