Aircel Cellular moves SC against Madras HC decision on spectrum charge
The high court in August ruled that the DoT could levy a one-time spectrum charge of Rs3,273 crore on Aircel Cellular
New Delhi: Aircel Cellular Ltd on Tuesday moved the Supreme Court to appeal against a Madras high court decision which upheld payment of a one-time spectrum charge of ₹ 3,273 crore to the Department of Telecommunications (DoT).
The high court in August ruled that the DoT could levy a one-time spectrum charge on Aircel Cellular, rejecting its claim that the department could only get a share of revenues generated from the telecom licences. The development in the high court was first reported by the Business Standard on 12 August.
Aircel Cellular’s lawyer Abhishek Manu Singhvi sought an early hearing of the case from the apex court.
A bench headed by Justice Anil R. Dave allowed the request for an early hearing, which will be held on 2 September.
The Madras high court ruling also impacted Aircel Ltd and Dishnet Wireless Ltd, whose appeals were dismissed too.
