Delhi HC rejects Gammon’s plea against DMRC refusal of technical bid
Court also rejects Gammon's plea that DMRC was blacklisting the firm, saying that the refusal only applied to the present tender
New Delhi: The Delhi high court on Wednesday rejected contractor Gammon India Ltd’s plea that a decision by the Delhi Metro Rail Corporation to not accept its technical bid was incorrect.
A bench of justices B.D. Ahmed and Sanjeev Sachdeva ruled that Gammon’s technical bid had been rejected by DMRC’s Technical Committee and the Tender Evaluation Committee for not adhering to required standards. Further, it held that the findings of such committees could not be faulted.
The court also rejected Gammon’s plea that DMRC was blacklisting Gammon, saying that the refusal only applied to the present tender and not to subsequent tenders.
The bid was in relation to a Ghaziabad metro line project for ₹ 665 crore. Gammon had claimed that its financial bid, which was not opened, was about ₹ 28 crore lower than the company to which the tender was awarded.
