SMS termination charges case: SC issues notice to Vodafone
Termination charge is supposed to be paid by the operator on whose network the SMS originates to the operator on whose network the SMS is sent
New Delhi: The Supreme Court on Friday issued notice to telecom company Vodafone Ltd in a plea filed by Aircel Ltd relating to fixation of SMS termination charges.
A bench comprising justices Kurian Joseph and Rohinton F. Nariman tagged the case with a batch of similar pleas against fixation of 10 paisa as SMS termination charges, which are to be paid to the company whose subscriber receives the message.
Earlier, Reliance Telecom and Tata Teleservices Ltd had moved the court against Bharti Airtel and Idea Cellular Ltd. Termination charge is supposed to be paid by the operator on whose network the SMS originates to the operator on whose network the SMS is sent.
The company has approached the court over an order passed by Telecom Disputes Settlement Appellate Tribunal (TDSAT), which mandated payment of termination charges for SMS @10 paisa per message.
In TDSATās impugned order of 31 March, fixation of 10 paise as SMS termination charges was upheld.
The cases will be heard next in September.
