Supreme Court to hear parties on Aadhaar Act challenge

New Delhi: The Supreme Court on Tuesday said it would hear the views of both sides in a challenge on the passing of Aadhaar Act by the Parliament as a money bill.

Former union government minister and parliamentarian Jairam Ramesh moved the apex court against the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, calling it unconstitutional.

Attorney general Mukul Rohatgi objected to Ramesh’s petition on two grounds—one, that no fundamental right was violated and two, a speaker’s certification of a money bill was beyond the scrutiny of the judiciary.

A bench comprising chief justice T.S. Thakur, justices R. Banumathi and U.U. Lalit asked Rohatgi and Ramesh’s lawyers—P. Chidambaram and Kapil Sibal—to file a note of their respective arguments and precedents.

Chidambaram argued that the matter was too grave to be thrown out merely on the ground that the petitioner, Ramesh, did not have the right to move the court under Article 32 of the Constitution.

“The court should consider whether this is a money bill and lay down guidelines on what should be a money bill or not," Chidambaram said.

The case will now be heard in July.

The Parliament passed the Aadhaar Act in March as a money bill, as it involves expenditure from the Consolidated Fund of India.
