DLF’s challenge to CCI penalty
The apex court will hear a plea by real estate developer DLF Ltd, challenging a ₹ 630 crore fine imposed on it by the Competition Commission of India (CCI) for alleged unfair business practices.
DLF was penalized by the competition regulator for allegedly abusing its dominant position by imposing “unfair and discriminatory" terms on its buyers through the buyers’ agreements. Read more.
Constitutionality of entry tax
A nine-judge bench of the Supreme Court will continue hearing a question of validity of entry tax levied by state governments on goods. Several companies, including Vedanta Aluminium Ltd, Essar Steel Ltd, Tata Steel Ltd and Adani Enterprises Ltd, contended that the entry tax provisions violate the right to free trade and commerce guaranteed under the Constitution. Plea against AAP’s appointment of legislators as Parliament secretaries
The Delhi high court will hear a plea challenging the appointment of 21 legislators as parliamentary secretaries by the Aam Aadmi Party (AAP).
The petition, brought by Rashtriya Mukti Morcha, alleges that the legislators enjoy the status and perks of ministers, including office space and official cars, which amounts to misuse of taxpayers’ money.
It alleges that these appointments are “unconstitutional, illegal and without jurisdiction" and should be cancelled. Read more.
Tobacco manufacturer’s plea against ban
The Delhi high court will hear a plea brought by various tobacco manufacturers, including Sugandhi Snuff King Pvt. Ltd and SK Tobacco Industries, seeking a stay on a ban imposed by the state government on manufacture, storage, distribution and sale of tobacco in various forms.
The Arvind Kejriwal-led Delhi government had on 25 March 2015 banned the sale, purchase, storage and manufacturing of all forms of chewable tobacco, including gutkha and paan masala containing tobacco. At an earlier hearing, the court was informed that since the effect of the notification was for one year, the matter had become infructuous. Read more.
