Court to decide on Subramanian Swamy’s plea in National Herald case on 26 Dec

New Delhi: A Delhi lower court will pass an order on 26 December on the plea filed by Bharatiya Janata Party (BJP) leader Subramanian Swamy seeking documents in the National Herald case.

The case relates to allegations of conspiracy, cheating, misappropriation of funds and criminal breach of trust by Swamy against Congress president Sonia Gandhi, vice-president Rahul Gandhi and other members of the party.

The complaint arose due to the acquisition of Associated Journals Pvt. Ltd (publisher of the then defunct National Herald newspaper which has since been revived) by Young India Pvt. Ltd (YIL) for Rs50 lakh from the Congress. According to Swamy, this allowed YIL to recover a Rs90 crore loan from AJL which was owed to the Congress.

Swamy filed an application seeking a large number of documents from the accused in the case, including minutes of board meetings of AJL, loan agreement between AJL and the Congress, ledger extracts of Congress and profit and loss accounts of the political party.

Swamy said his case was based on documents and could be proved using the material he had asked for.

Lawyers R.S. Cheema and Rebecca John, representing some of the accused in the case, however, objected to the documents sought by Swamy, saying that these were beyond the scope of the complaint made by him, especially since the Congress and AJL were not accused in the case.

The request for documents expanded the scope of the complaint, John argued. Further, the documents asked for did not have a specific time period mentioned, she added.

Metropolitan magistrate Lovleen agreed to pass an order on 26 December.

The court had, in March, summoned Congress’ balance sheet for 2010-11.
