Delhi HC to determine relevance of documents seized by CBI

New Delhi: The Delhi high court on Monday directed the Central Bureau of Investigation (CBI) to submit to the court copies of the documents seized by them during a raid at the office of Rajendra Kumar, principal secretary of Delhi chief minister Arvind Kejriwal, in order to determine their relevance.

The court also directed a copy of the documents to be supplied to the Delhi government in two days.

The court’s direction came on a plea by CBI seeking a stay on a trial court order directing the agency to release the documents seized by them to the Delhi government.

Justice P.S Teji observed that the question to be decided by the court was whether the documents seized by CBI are to be retained by them or returned to the Delhi government.

“Although the trial court directs for the documents to be returned to Delhi government, I would like to show that they are relevant for the investigation," additional solicitor general Tushar Mehta said, appearing for CBI.

The documents, which will be examined by the court, were sought to be returned to the Delhi government under an order of the trial court on 20 January.

On 15 December, CBI had conducted a raid in the office of Rajendra Kumar to investigate alleged corrupt practises by him under his official authority and seized certain documents to help in the process of such investigation.

The Delhi government had opposed this, claiming that seizing of documents was indiscriminate and that not all documents seized by the agency were relevant to the investigation.

The matter will be heard next on 29 January.
