Madurai: Janata Party welcomed Allahabad High Court’s order on the minority status of Muslims in the Uttar Padesh (UP).
Party president Subramanian Swamy described the order, which held that Muslims in the UP could no longer be treated as a religious minority, as a “land mark verdict” given by Justice S N Srivastava.
On the recent demand by Pakistan to seek the wishes of the people of Jammu and Kashmir on the ‘Kashmir issue´, he said “such a demand would be suicidal for Pakistan”.
Jammu and Kashmir became a part of India as per the Accession agreement signed by the then Maharaja of the province.
“If the accession could be called for question today, the creation of Pakistan also could be disputed by Indians”, he said.
Pakistan’s establishment and Jammu and Kashmir’s accession derive their legitimacy from the Indian Independence Act passed by the British Parliment in June 1947 and did not require to be ascertained by the wishes of the people, he said.
“If Pakistan keeps raising the legality of the merger, then Indians will have the right to question the legality of Pakistan itself because the creation of Pakistan and the ‘Instrument of Accession´ draw their legal sustenance from the same source-the Indian Independence Act”, he said.
