Kerala HC vacates order on weekly lottery draw

Kochi: The Kerala high court has ruled against restricting government lottery draws to once a week and also ordered the Kerala government to collect advance sales tax from Megha Distributors, the sole operator for the lotteries conducted by the royal government of Bhutan.

A division bench comprising T.B Radhakrishnan and P. Bhavadasan on Thursday vacated an earlier ruling of a single bench to restrict draw of lotteries to once a week. It said governments could have draws under different schemes.

Dismissing a petition filed by the state government against the single bench order to collect advance tax from Megha Distributors, the division bench ruled that the agency was the promoter of the lottery run by the Bhutan government and the state government was bound to collect advance tax from it. Tax is collected at Rs7 lakh per draw and the court ruled that the government should accept this for the month of October.

Following a single bench order in August, the state government had restricted lottery draws to four a month on once a week basis from the earlier 30 a month.
