SC remands Hasan Ali to ED’s custody

New Delhi: Hasan Ali Khan will be taken in for custodial interrogation by the Enforcement Directorate (ED) following an order of the Supreme Court on Thursday.

The SC passed the order after Khan was granted bail by a special court in Mumbai last week, noting that these were "extraordinary circumstances".

Khan is one of the people being probed under the Prevention of Money Laundering Act (PMLA) for allegedly stashing away “millions of dollars" in European bank accounts.

Solicitor General Gopal Subramanium, appearing for the ED told the apex court that if Khan was not taken into custody forthwith the investigation would be compromised.

The apex court passed the order despite Khan not being represented by legal counsel in court.

Khan’s case came under judicial and media glare in the course of a public interest litigation filed by senior lawyer Ram Jethmalani to unearth tax evaded monies in foreign bank accounts.

The ED contended that the PMLA is a special law which empowers the agency to question persons for prima facie evidence found out against them.

Meanwhile, Kashinath Tapuriah, alleged by the income tax department to be a close associate of Khan, has filed an application in the Supreme Court asking the court to allow him to intervene and present his side of the story.
