FCRA violation case: CBI moves Supreme Court to cancel Teesta Setalvad’s anticipatory bail

CBI seeks custodial interrogation of Setalvad and her husband Javed Anand for alleged violation of FCRA

New Delhi: The Central Bureau of Investigation (CBI) has petitioned the Supreme Court to cancel activist Teesta Setalvad’s anticipatory bail in a case of her organization receiving foreign funds.

The agency sought custodial interrogation of Setalvad and her husband Javed Anand for alleged violation of the Foreign Contribution (Regulation) Act, or FCRA, as reported first by The Economic Times on 24 September.

CBI appealed against an 11 August Bombay high court decision granting Setalvad and Anand anticipatory bail after asking them to cooperate with the investigation.

CBI registered a case against Setalvad and Anand in July, saying that Sabrang Communications and Publishing Pvt. Ltd, a company run by them, had received foreign funding in violation of FCRA. They allegedly received 1.8 crore from US-based Ford Foundation without seeking mandatory permission from the central government.

On 10 September, the home ministry cancelled Setalvad and Anand-run Sabrang Trust’s registration for six months for violating FCRA. The couple’s other organization, the Citizens for Justice and Peace, has been put under the prior permissions category, which means that it will require the centre’s approval before accepting foreign contributions.

On 11 September, in a separate embezzlement case, the apex court extended the anticipatory bail granted to the activist couple till 15 October. That case is likely to be listed on 28 September.
