Mullaperiyar dam dispute: SC rules in favour of Tamil Nadu

Court quashes Kerala's 2006 Dam Safety Act, which sought to restrict the water level at the dam on safety grounds

Chennai: The Supreme Court on Wednesday ruled in favour of Tamil Nadu to bring to a close the state’s eight-year-old dispute with neighbouring Kerala over sharing of water from the Mullaperiyar dam.

A five-member constitution bench of the apex court struck down Kerala’s 2006 Dam Safety Act, which sought to restrict the water level at the dam on grounds of safety.

The ruling addressed Tamil Nadu’s complaints that by restricting the water level, Kerala was denying Tamil Nadu its rightful share of water from the 117-year-old dam, located on the Periyar river in Kerala.

The bench headed by justice R.M. Lodha said that the water level can be raised to 142 feet from 136 feet. It also ordered the establishment of a three-member committee for the maintenance of the dam.

The Tamil Nadu government had filed a case in March 2006 challenging amendments to Kerala’s Irrigation and Water Conservation Act brought in by the Kerala government in the same year.

Although Tamil Nadu is entitled to waters from the dam for its border districts, Kerala has repeatedly argued that raising the water level—needed to share the water—will compromise the safety of the dam.

But the Supreme Court, going by the Justice Anand Commission report on structural safety, declared the dam structurally safe.
