Special bench to hear Bhopal curative petition today

New Delhi: The Supreme Court has constituted a special bench of five judges led by Chief justice S. H. Kapadia to hear the central government’s plea on revising the compensation from Union Carbide Corporation, a unit of US-based The Dow Chemical Co., for the 1984 Bhopal Gas Tragedy and the subsequent damage caused. The court will start hearing the case on Monday.
In December last year the government moved the apex court through a curative petition where it is claiming Rs7,844 crores ($1.74 billion) as additional compensation for the loss of life, property and environmental contamination.
The government is basing this new claim on three footings: incorrect assumption of the deaths, injuries and losses; expenses incurred by the Madhya Pradesh and the Central governments; and the subsequent environmental degradation.
