New Delhi: The World Bank has agreed to provide funds to the capital-based International Centre of Alternative Disputes Resolution (ICADR) for preparing a business plan and training mediators for settlement of commercial disputes, law minister H R Bhardwaj said on 30 June.

“The permanent court of arbitration is also considering establishment of its facility in India to cater to the needs of South Asian countries," the minister said, adding that recent legal reforms will provide comfort to investors in India that their commercial disputes will be resolved faster.

Inaugurating 47th annual session of the Asian African Legal Consultative organisation (AALCO), Bhardwaj said “We can share experience of AALCO with the institutions concerned in India to gain from the organisation’s experience in this area."

Elaborating on the legal reforms in India, the Law Minister said the country has taken initiative to promote alternative dispute resolution mechanism with a view to check the huge backlog of cases.

“We have brought about necessary changes in the code of civil procedure which mandates every judicial officer to explore the possibility of settling the civil disputes through alternative disputes resolution mechanism," he said.

It is only when the parties involved in a legal dispute fail to arrive at a consensus following this mechanism that the court will proceed further, Bhardwaj said.

The minister also highlighted the recently-introduced provision of “plea bargain" in the criminal justice administration system to ensure cases are disposed of faster.

Bhardwaj congratulated AALCO for its activities in the field of international trade law matters and economic relations.

“This is the only organisation at inter-governmental level embracing two continents of Asia and Africa and which has been accorded permanent observer status at the United Nations," he said.

The AALCO’s annual session is likely to discuss issues related to legal protection of migrant, international terrorism, human rights in Islam, law of the sea and issues related to the International Law Commission.
