SC sets aside Karnataka HC verdict against Sadananda Gowda over land misuse

SC quashes the verdict which deemed that Sadananda Gowda had flouted the construction norms placed on his land allotted in Karnataka

New Delhi: The Supreme Court on Friday set aside a 2012 Karnataka high court verdict which deemed that law minister D.V. Sadananda Gowda had flouted the construction norms placed on his land allotted in Karnataka.

A bench headed by Justice Madan B. Lokur accepted his appeal and set aside the 19 October 2012 verdict of the high court.

Gowda and D.N. Jeevaraj, Bharatiya Janata Party (BJP) leader from Karnataka, had moved the apex court after the Karnataka high court had set aside construction permits given to them for two plots of land in Bengaluru.

On 19 October 2012, the high court also asked the Bangalore Development Authority (BDA) to take action against them within three months for failing to comply with the conditions based on which the land was granted to them.

The case has been suspended since 2 January 2013 after the apex court stayed the proceedings.

Gowda and Jeevaraj had been allotted adjoining plots of land in HSR (Hosur Sarjapur Road) Layout, Bengaluru. The BDA, then, entered into lease-cum-sale agreements with them. Under these agreements, they were not to divide the plots further or construct more than one house.

However, according to the public interest petitioner in the high court, Nagalaxmi Bai, Gowda and Jeevaraj merged the two plots to construct a shopping complex of five floors.
