Full state status will be restored to J&K at appropriate time: Amit Shah in RS

Rajya Sabha approves a bill to extend 10% reservation to economically weaker sections in J&K

    Amid heightened tension in Jammu and Kashmir, Home Minister Amit Shah moved Rajya Sabha to scrap Article 370 in Jammu and Kashmir, removing the special status granted to the state of Jammu and Kashmir. The order, which has been signed by President Ram Nath Kovind, comes into force immediately.

    Earlier, the Union Cabinet, headed by Prime Minister Narendra Modi, had a hour-long meeting, where the top leadership is believed to have discussed issues concerning Jammu and Kashmir.

    Here are the latest updates on how things are unfolding:

    6:55 pm: The Jammu & Kashmir Reorganization Bill, 2019 got passed by Rajya Sabha, which will split Jammu and Kashmir into two union territories. The bill gets 125 Ayes, 61 Noes and one abstains.

    6:40 pm: No separate Constitution, flag for J-K; assembly to be of 5 years

    With the abrogation of Article 370, Jammu and Kashmir will now have no separate flag or Constitution and the tenure of the assembly will be for a period of five years like any other state and two union territories in the country, officials said on Monday.

    The Indian Penal Code (IPC) will replace the Ranbir Penal Code (RPC) to deal with criminal matters and Article 356, under which President's rule can be imposed in any state, will also be applicable in union territories (UTs) Jammu and Kashmir, and Ladakh with the unprecedented decision of the Centre.

    There will be no separate flag of Jammu and Kashmir and the tricolour will be the only national flag for the entire country, a Home Ministry official said.

    6:35 pm: Rajya Sabha passes J&K reservation bill. This Bill is to implement 10% Economically Weaker Section (EWS) quota in Jammu and Kashmir.

    6:25 pm: "We will make Jammu and Kashmir the most developed state; dont be misguided by political parties," Home Minister Amit Shah said in Rajya Sabha

    "Full state status will be restored to Jammu and Kashmir at appropriate time, when normalcy returns," Shah added.


    6:20 pm: "More than 41,400 people have been killed due to terrorism in Jammu and Kashmir; whose policy responsible for the deaths?," asked Home Minister Amit Shah in Rajya Sabha.

    "Article 370 was a temporary provision; how long can a temporary provision be allowed to continue," Shah said.

    "Sardar Patel never dealt with Kashmir; he dealt with Junagarh, Hyderabad which were made part of India without Article 370," Shah added.

    6:10 pm: After abrogation of Article 370, J&K will truly become integral part of India, Shah said in Rajya Sabha.

    6:05 pm: While asserting that poverty in J&K is due to Article 370 and Article 35A, Home Minister Amit Shah spoke in Rajya Sabha and said,"No industry can be set up in J&K because of Article 370, 35A; no benefit will accrue to valley due to Article 370, Article 35A. Tourism did not develop in J&K because of restrictions on land purchase due to Article 370 and Article 35A. Cement costs 100 per bag more in Kashmir; land price in state did not rise. 14,255 per capita allocated to J&K as against over 3,681 per capita national average."

    "Right to Education is not implemented in Kashmir; why should valley children not get benefit of education," Shah asked and added, "Healthcare crippling in Jammu and Kashmir as no private hospital could be set up due to Article 370, Article 35A."


    5:55 pm: Over 41,000 people wouldn't have lost their lives in Kashmir valley if Article 370 wasn't there, said Home Minister Amit Shah in Rajya Sabha.

    Article 370 is root cause of terrorism in Jammu and Kashmir, said Shah. Three family rule did not allow democracy to percolate in J&K, Shah further said.

    5:20 pm: Govt's next agenda should be getting back PoK: Swamy in RS

    After scrapping of Article 370, the government's next agenda should be to get back the Pakistan occupied Kashmir (PoK), Rajya Sabha nominated member Subramanian Swamy said on Monday. Supporting the resolution on removal of Article 370 moved in the Upper House, Swamy also said that now there is nothing to mediate in the Kashmir issue for the US President Donald Trump except for him to tell Pakistan Prime Minister Imran Khan to return the land taken illegally from India.

    4.55 pm: It is something the country has been waiting for the last 70 years, says Finance Minister Nirmala Sitharaman.

    4.37 pm: 'Momentous decision', says S M Krishna

    Former External Affairs Minister S M Krishna on Monday termed as a "momentous decision" the Central government revoking Article 370 and said it ends a huge ambiguity about Kashmir.

    "This step ensures the completion of the integration of India started by Sardar Patel," the BJP leader said.

    4.30 pm: Article 370 abolition to push J&K development: Gujarat residents

    Welcoming the Centre's move to abolish Article 370 on Jammu and Kashmir, people from a cross- section in Gujarat hoped the landmark decision would bring peace and development in the strife-torn state.

    4.25 pm: J&K's head chopped off; identity lost: Ghulam Nabi Azad on Kashmir resolution

    Some opposition parties termed the scrapping of Article 370 in Jammu and Kashmir and its bifurcation into two union territories as a "black blot", with Congress leader Ghulam Nabi Azad Monday charging the state's head, considered as India's crown, has been "chopped off" and its identity removed.

    4.20 pm: Various parties like the Congress, TMC, DMK, NCP, AAP, RJD and left parties opposed the said resolution as well as a bill to bifurcate the state into two union territories.

    4.15 pm: Kashmiri students in the national capital on Monday termed the Centre's move of revoking Article 370 as "dictatorial" and expressed concern about the safety of their family members back home.Former Jawaharlal Nehru University Students' Union (JNUSU) member Shehla Rashid, who has been vocal against the scrapping of Article 370, said they will approach the Supreme Court in the matter.

    4.10 pm: Similar to imposition of Emergency: Historian Ramachandra Guha

    Historian Ramachandra Guha claimed on Monday the notification by President Ram Nath Kovind on revoking Article 370 is similar to the one issued by the then President Fakhruddin Ali Ahmed on imposition of Emergency in 1975.

    "President Kovind does a Fakhruddin Ali Ahmed," he said.

    "This is not democracy, this is authoritarianism, the handiwork of paranoid, insecure rulers who daren't even have a proper debate inside or outside Parliament," Guha added.

    3.30 pm: Punjab Chief Minister Captain Amarinder Singh: Constitution of India had been rewritten without following any legal provisions. Such a historic decision should not have been taken and pushed through in this arbitrary manner.

    3.20 pm: NSA Ajit Doval is expected to visit Kashmir valley today along with other senior security officials to review the situation on ground, ANI reported

    3.05 pm: Pakistan on Monday slammed India’s move of revoking Article 370 of its constitution. In a statement, the Pakistan foreign ministry said Islamabad will exercise all possible options to counter the illegal steps, being a party to the international dispute. Read more

    2.55 pm: Article 35A gave J&K government the right to decide who qualifies as a permanent resident of the state and only these individuals were allowed to acquire or own land, settle and seek government jobs in J&K region. However, revoking Article 35A would most likely open gates for real estate investments in J&K from across the country. Read more

    Senior BJP leader and former deputy Chief Minister Nirmal Singh too congratulated the people and said the whole country had waited for over 70 years for this moment.

    "Jammu and Kashmir has integrated into India and the historic decision of the Centre will further cement its relation with the state. The bill will get passed to fulfil the long standing dream of the people of Jammu and Kashmir," Singh said.

"Some leaders in Kashmir have been house arrested, school, colleges have been closed and Section 144 has been imposed in the Valley. It has been imposed for the first time by the government and not separatists. Government is going to take some big step or decision on Kashmir," Raut told ANI.

Home Minister Amit Shah said the UT in Ladakh will have no legislature like Chandigarh while the other UT of Jammu and Kashmir will have a legislature like Delhi and Puducherry.     11.40 am: Shah also proposed the reorganization of the state, with Jammu and Kashmir to be declared a Union Territory with an Assembly.

    11.37 am: Shortly after Amit Shah tabled these documents, President Ram Nath Kovind came out with a notification—The Constitution (Application to Jammu and Kashmir) Order, 2019 that will come into force immediately.

    The order will supersede the Constitution (Application to Jammu and Kashmir) Order, 1954 as amended from time to time.

    The notification also made clear that all the provisions of the Constitution as amended from time to time, shall apply in relation to the state of Jammu and Kashmir and the exceptions and modifications subject to which they shall so apply.

    It also added a clause (4) to Article 367 which said,"(4) For the purposes of this Constitution as it applies in relation to the State of Jammu and Kashmir -

    (a) references to this Constitution or to the provisions thereof shall be construed as references to the Constitution or the provisions thereof as applied in relation to the said State;

    (b) references to the person for the time being recognized by the President on the recommendation of the Legislative Assembly of the State as the Sadar-i-Riyasat of Jammu and Kashmir, acting on the advice of the Council of Ministers of the State for the time being in office, shall be construed as references to the Governor of Jammu and Kashmir;

    (c) references to the Government of the said State shall be construed as including references to the Governor of Jammu and Kashmir acting on the advice of his Council of Ministers; and

    (d) in proviso to clause (3) of Article 370 of this Constitution, the expression "Constituent Assembly of the State referred to in clause (2)" shall read "Legislative Assembly of the State"."
