New Delhi: The Competition Commission of India (CCI) has ordered an investigation against telecom equipment vendor Ericsson AB over allegations of “discriminatory practices” on the basis of a complaint filed by Intex Technologies (India) Ltd, a New-Delhi based company.
A CCI spokesperson said the investigation, to be conducted under Section 26(1) of the Competition Act, would be clubbed along with a similar investigation that is already underway against the Swedish company.
The earlier case was filed on a complaint by Micromax Informatics Ltd, a Gurgaon-based mobile phone maker.
The spokesperson said the two cases were clubbed as they are of a similar nature. The earlier investigation was ordered in November last year.
Both cases essentially refer to Ericsson allegedly demanding unfair, discriminatory and exorbitant royalty for its GSM technology-related patents.
According to a November order by CCI, Ericsson has 33,000 patents to its credit, with 400 of these granted in India. The company was the largest holder of standard essential patents for mobile communications technologies for smartphones and tablets, the Press Trust of India had reported in November.
A statement from Ericsson said: “Ericsson has made numerous attempts to sign a licence agreement with Intex Technologies on fair, reasonable and non-discriminatory (FRAND) terms but has to date failed to do so... Ericsson does not agree with the allegations made by Intex Technologies but will fully cooperate with the authorities to reach a fair and reasonable conclusion.As this is on-going investigation we cannot comment any further.”
