SC dismisses Kingfisher Airlines’ plea on TDS
Kingfisher had challenged a Karnataka HC ruling which required the airline to pay nearly Rs372 crore towards TDS
New Delhi: The Supreme Court (SC) on Monday dismissed a Kingfisher Airline (KFA) plea challenging a Karnataka high court ruling which required the airline to pay nearly 372 crore towards TDS (tax deducted at source) payments.
On 15 July last year, the high court had upheld a 2011 assessment by the assistant commissioner of income tax (ACIT) by which KFA owed the government a total demand of 372,09,44,786. The ACIT had alleged that KFA had had deducted TDS but failed to remit the money to the government.
This verdict said that the liability that KFA owed to the government was “not in dispute". However, it had allowed KFA to produce receipts of past payments and the ACIT was to take note of the same.
KFA’s petition, a copy of which Mint reviewed, claimed that the high court had not considered that the ACIT tax demand orders were beyond its powers.
A bench with justices Ranjan Gogoi and N.V. Ramana, however, did not entertain KFA’s plea.
A KFA spokesperson could not be reached over phone and did not respond to a text message.
