Vodafone tax dispute: SC dismisses PIL against arbitration

SC slams Bishwajit Bhattacharya, saying writ petitions are not filed without adducing evidence of income-tax dept's inaction

New Delhi: The Supreme Court on Tuesday dismissed a public interest litigation (PIL) for payment of tax dues by Vodafone Group Plc by enforcing the retrospective amendments to the Income-Tax Act.

A bench of justices H.L. Dattu and S.A. Bobde said writ petitions are not filed in this manner without adducing evidence of the income-tax department’s inaction. “You are an experienced person," the bench told Bishwajit Bhattacharya, speaking through justice Dattu, adding that he ought to have approached the tax department by way of a right to information (RTI) application to know the steps taken.

Former additional solicitor general and tax expert Bhattacharya had filed the PIL claiming subversion of rule of law by not enforcing the retrospective amendment to the Income-Tax Act, leading to dues in the nature of 20,000 crore payable by Vodafone.
