New Delhi: The Competition Appellate Tribunal (Compat) on Wednesday dismissed an appeal by sportsgear manufacturer Adidas India Marketing Pvt. Ltd against rival Nike India Pvt. Ltd, as well as the Board for Control for Cricket in India (BCCI) and cricketer Sachin Tendulkar.

Former Supreme Court judge and present Compat chairperson G.S. Singhvi also ordered Adidas to pay costs of 1 lakh “for filing a frivolous complaint and compensation application, the disposal of which has consumed substantial time" to be used “for providing legal aid in deserving cases".

Adidas had entered into an agreement with Tendulkar on 14 May 2004 to endorse its brand and products. As per the terms of this contract, Tendulkar was to not “wear, promote, use or otherwise endorse any product of a competitor of Adidas" with certain exceptions.

In 2005, Nike won a tender to sponsor and supply footwear, clothing and other cricketing accessories to the BCCI for five years beginning from 1 January 2006. After this, a line of “Nike Cricket Hero Tees" were released with names of the members of the Indian cricket team on them.

Adidas sent a legal notice to BCCI and Nike saying that t-shirts with Tendulkar’s name on them constituted a breach of the May 2004 agreement with Adidas. Adidas also claimed that it would amount to an “unfair trade practice" under Section 36-A of the Monopolies and Restrictive Trade Practices (MRTP) Act 1969.

In 2010, after the Competition Act, 2002 came into force, all the matters pending before the MRTP Commission were transferred to the Compat.

Dismissing Adidas’ complaint, the Compat held that there was no evidence to prove that Nike indulged in any unfair trade practice.

Adidas refused to comment. An email query sent to Nike remained unanswered.
