Justice Manmohan Singh calls for expedited decision-making to address counterfeiting

Court determining genuineness of goods is sufficient to decide a case of counterfeiting, says Delhi HC judge

New Delhi: Determination by a court regarding the genuineness of goods is sufficient to decide a case of counterfeiting, justice Manmohan Singh of the Delhi high court said on Wednesday, calling for expedited decision-making in addressing issues of piracy and counterfeiting.

“I feel that if the court has come to a conclusion that these goods are spurious, nothing more is required. No evidence is required," he said.

Singh compared counterfeiters to members of organised crime, or the mafia, and asked people to discourage counterfeiters.

“A person dealing with anti counterfeiting product is associated with some mafia as everybody is aware that in counterfeiting products nothing is required, one can have ready made goodwill and reputation," Singh said.

Singh inaugurated the event— “Combating Counterfeiting and Piracy in the ‘Make in India’ Environment" organised by law firm Anand and Anand and industry body Asian Coalition Against Counterfeiting and Piracy.

China continued to be a recurring cause for concern for brand owners and enforcement agencies, as it serves as one of the largest sources of counterfeit products in the country, according to the panel discussions at the event.

Representatives from brands like Apple Inc, Louis Vuitton, Nike, speaking at an event, showed how best to identify their genuine products from fake ones.
