Ola, Uber move Delhi high court seeking quashing of challans against them

Ola and Uber challenged the Delhi government's jurisdiction to issue challans, a practice which they called 'arbitrary'

New Delhi: App-based taxi services Ola and Uber, in an application, moved the Delhi high court on Friday seeking the quashing of challans issued by the transport department of the Delhi government for failing to use calibrated meters in their taxis.

Justice Manmohan sought a reply from the Delhi government and stated that such issues were better avoided at this stage as a direction for putting in place a national policy to end confusion due to operation of app-based taxi services had already been passed by the court.

Ola and Uber challenged the state government’s jurisdiction to issue challans, a practice which they called “arbitrary," and impound their vehicles.

The Delhi government, through advocate Rahul Mehra, explained its reasons for issuing the challans.

“App-based taxi services cannot be extended immunity in the time that the committee framing the national policy submits its report. They are in violation of provisions of the Motor Vehicles Act, 1988," Mehta argued.

On 11 August, the court had directed a panel appointed by the central government to come up with a policy to govern all cab services nationwide.

Experts from law enforcement, traffic and environment management and technology were sought to be made part of the expert committee. The committee was given three months to submit its report.

The court was hearing a batch of cases, including one by the Association of Radio Taxis, which has repeatedly complained that Ola was plying diesel vehicles in Delhi in violation of Supreme Court orders, the Radio Taxi Scheme, 2006, and City Taxi Scheme of 2015.

The case will be heard next on 6 September.
