Delhi HC asks centre to file action taken report on streamlining transport system

Delhi High Court's justice Manmohan granted eight weeks to the Delhi government to finalise its plan for taxi services in the national capital territory

New Delhi: The Delhi high court on Monday asked the Union government to file an action taken report (ATR) on steps taken to implement measures to streamline the transport sector, including regulating the taxi aggregator space.

The Union government’s amendment to the Motor Vehicles Act is likely to be presented before Parliament in the ongoing budget session. The amendment includes a provision to define aggregators and mandates licensing of such digital intermediaries, which connect a customer/passenger to a driver for the purpose of transportation.

The Delhi government also sought time from the court to finalise its plan for taxi services in the national capital territory.

Justice Manmohan granted eight weeks to the Delhi government for the same. The court will hear the case next on 17 April, when the centre’s action taken report will also be considered.

In August 2016, the court had directed a committee set up under the ministry of road transport and highways to submit a report on framing a policy to govern all cab services in the country. The committee submitted its report in December 2016.

Justice Manmohan of the Delhi high court is hearing a batch of petitions related to plying of Ola and Uber cabs in the city. One of the petitioners, Association of Radio Taxis (comprising taxi companies such as Meru Cabs, Mega Cabs and Easy Cabs), complained that these cabs violated the Radio Taxi Scheme and charged high fares (through surge pricing). The app-based cab aggregator countered these allegations claiming that they didn’t fall within the purview of the state’s Radio Taxi Scheme.
