Supreme Court stays NCDRC proceedings against Maggi

The court will now hear the case on 13 January along with an appeal filed by the food regulator against Bombay HC order lifting the ban on Maggi noodles

New Delhi: The Supreme Court on Wednesday barred the National Consumer Disputes Redressal Commission (NCDRC) from proceeding in a class-action suit filed by the central government against Nestlé India Ltd, in a win for the Indian subsidiary of the Swiss food giant.

The Union government had moved the top consumer forum alleging unfair trade practices, false labelling and misleading advertisements by Nestlé and sought compensation of 640 crore.

A bench comprising justices Dipak Misra and P.C. Pant also said Nestlé’s Maggi noodles samples—which NCDRC had directed to be tested at a Chennai laboratory—will now be tested at the Central Food Technological Research Institute (CFTRI) in Mysore.

The court said the 13 August order of the Bombay high court lifting the ban on Maggi had to be considered. “Had the Bombay high court not cleared them, it would have been a different matter," the court said.

On 10 December, the NCDRC ordered testing of 16 samples of Maggi at a Chennai laboratory.

The court directed that the reports of two tests ordered by the NCDRC—on 15 October and 10 December—be placed before it. Both tests will be conducted by the CFTRI lab, which is approved by the Food Safety and Standards Authority of India.

The court will now hear the case on 13 January along with an appeal filed by the food regulator against the Bombay high court order.

“We await the formal order," said a Nestlé India spokesperson. “The proceedings before the NCDRC are stayed. As against the directions of NCDRC to send the samples for testing to Export Inspection Agency, Chennai laboratory, Nestlé consented to send the same samples to NABL accredited government referral laboratory viz. CFTRI, Mysore. This request was accepted. Reports of the 13 samples already sent to CFTRI Mysore and the additional 16 which are being sent to CFTRI now, are to be forwarded to the Supreme Court instead of NCDRC."

Nestlé India said it has conducted over 3,500 tests representing over 200 million packs in both national and international accredited labs in the recent months and all reports are clear. Various countries, including the US, the UK, Singapore, Australia and others, have found Maggi noodles, exported from India, to be safe for consumption.

“100% of the samples tested show Maggi Noodles is safe for consumption and indicate lead to be much below the limit stipulated by the regulatory authorities. This was also validated by the reports from 3 accredited laboratories mandated by the Hon’ble Bombay High Court to test the samples," the company said in a statement.
