HC restrains Delhi govt from taking any action against app-based cabs

New Delhi: In order to avoid any interruption in framing of rules which will govern cab services nationwide, the Delhi high court on Tuesday directed the Delhi government not to take any action against app-based taxi providers such as Ola and Uber until such policy is framed by a special committee.

“Till a national policy is passed, you have to trust them and not take any action against them," said Justice Manmohan.

On 2 September, Ola and Uber had challenged the state government’s jurisdiction to issue challans, a practice which they called “arbitrary," and impound their vehicles. They had sought quashing of such challans.

The Delhi government had contended that app-based taxi services could not be extended immunity in the time that the committee framing the national policy submits its report. It was added that app-based taxi providers were in violation of provisions of the Motor Vehicles Act, 1988.

A national policy that would govern all cab services nationwide was directed to be put in place by the court on 11 August by a panel appointed by the central government.

Experts from law enforcement, traffic and environment management and technology were sought to be made part of the expert committee. The committee was given three months to submit its report.

The court was hearing a batch of cases, including one by the Association of Radio Taxis, which has repeatedly complained that Ola was plying diesel vehicles in Delhi in violation of Supreme Court orders, the Radio Taxi Scheme, 2006, and City Taxi Scheme of 2015.
