Mercedes Benz seeks lifting ban on registration of luxury cars
The Supreme Court will hear a plea from auto maker Mercedez Benz seeking lifting the ban on registration of luxury vehicles, or cars with engine capacity above 2000cc. Mercedez Benz agreed to deposit an additional 1% of its invoice value with the court as an environment cess. The court has already reserved order on the issue of allowing luxury vehicles back on the roads. Read more here.
Unitech, Sahara India plea against consumer forum decisions
The apex court is also set to hear a bunch of appeals from various builders, including Unitech and Sahara India Commercial Corporation Ltd, appealing against decisions of the consumer disputes forum. Unitech has appealed two different decisions regarding a Gurgaon project, Vistas, and a Noida project, Burgundy. Read more here and here
SpiceJet’s appeal against KAL Airways in share transfer dispute
The Delhi high court will hear SpiceJet’s appeal against KAL Airways against a 29 July ruling over a share transfer dispute with KAL Airways Pvt. Ltd. On 29 July, justice Manmohan Singh of the Delhi high court directed SpiceJet to deposit ₹ 579 crore in five equal monthly instalments with the court registry, the first of which is due by 7 August. The court also asked KAL Airways and SpiceJet to set up an arbitral tribunal to resolve the issue.
One of the main issues that SpiceJet has raised for appealing the 29 July order, the airline’s lawyer C. A. Sundaram told the court, was that the July ruling amounted to an interim order under the Arbitration Act, even when there was no pending arbitration between the two parties.
The case relates to a dispute arising out of non-issuance of warrants in favour of KAL’s non-executive chairperson Kalanithi Maran, after transfer of ownership to Ajay Singh, the current controlling shareholder of SpiceJet. Read more
Plea seeking parity in FDI regulations in e-commerce
The Delhi high court will hear a plea by the All India Footwear Manufacturers and Retailers Association for parity in foreign direct investment (FDI) norms between e-tailers and retailers.
On 29 March, the government issued a press note, allowing 100% FDI for online retailers following a marketplace model and restricted them from offering more than 25% discount from one vendor. Read more

Recruitment of women in territorial army
The Delhi high court will hear a plea seeking recruitment of women in the Territorial Army (TA), an organisation of volunteers who receive military training in order to be mobilized for the country’s defence in case of an emergency.
At present, only employed men are recruited into the TA, the second line of defence after the regular Indian Army, which the petitioner, Kush Kalra, alleges smacks of discrimination.
