SC notice to Centre on disqualification of lawmakers in criminal cases
The Supreme Court seeks the centre's response on disqualification of lawmakers in criminal cases within four weeks
New Delhi: The Supreme Court on Friday issued notice to the centre on a fresh plea seeking disqualification of elected representatives by the Election Commission of India upon conviction in criminal cases.
A bench comprising chief justice T.S. Thakur, justices Ibrahim Kalifulla and A.M. Khanwilkar heard the plea and sought the centre’s response within four weeks.
The petitioner Lok Prahari, a non-profit organization, sought implementation of the apex court’s verdict in 2013 disqualifying members of Parliament (MPs) and members of the legislative assembly (MLAs) convicted of a crime and sentenced to two years or in prison.
The fresh plea said the Election Commission should be empowered to automatically cancel membership of convicted MPs and MLAs.
