SC asks tobacco Institute to move high court
Supreme Court asked the lobby group Tobacco Institute of India to approach the Karnataka high court for the same
New Delhi: The Supreme Court on Friday declined to allow the Tobacco Institute of India (TIA), a lobby group of the cigarette segment of the tobacco industry, to sell its existing stock of cigarette packs with 40% pictorial warnings.
A bench comprising justices P.C. Ghose and Amitava Roy asked TIA to approach the Karnataka high court for the same.
Lawyer Arvind Datar, representing TIA, asked the court to allow to them to sell the stock manufactured before 1 April as they adhered to the 40% pictorial warnings rule.
The health ministry, on 24 September last year, notified the implementation of the Cigarettes and other Tobacco Products (Packaging and Labelling) Amendment Rules, 2014, which mandates 85% pictorial warnings on both sides of the tobacco product packages. The rule came into force on 1 April.
The apex court, on 4 May, directed all cases pending on this issue at various high courts to be heard at the Karnataka high court.
