Mumbai: The Bombay high court on Monday directed the Maharashtra government and scam-tainted Adarsh Housing Society to file their responses to the ministry of defence’s (MoD) claim that the land on which the building is built on, belongs to the ministry.

The defence ministry filed a title suit in the Bombay high court following an interim report by the state government appointed judicial commission in April 2012, which rejected its claim about the ownership of land and stated that the land belonged to the state government.

Justice S.J. Kathwala on Monday asked the state government and society to submit their written undertakings by 8 October, the next date of hearing in the case. The final report by the judicial commission was submitted to the state government in April this year and it is expected that it will be submitted during the ongoing monsoon session of the state assembly that started on Monday.

In the wake of irregularities in the allotment of flats in a society meant for the Kargil war heroes and their survivors, then chief minister Ashok Chavan had to quit in November 2010. It was found that, close relatives of Chavan like his mother-in-law, sister-in-law and brother-in-law were allotted flats in the society.
