Arvind Kejriwal Supreme Court Hearing Highlights: The Enforcement Directorate arrested Arvind Kejriwal in the alleged excise policy scam on March 21. The Delhi Rouse Avenue Court has also extended his judicial custody till April 23.

Arvind Kejriwal Supreme Court Hearing Highlights: The Supreme Court has on April 15 issued a notice to the Enforcement Directorate (ED) on Delhi CM Arvind Kejriwal's petition seeking his release from custody in relation to the alleged Delhi excise scam case.

The apex court will hear the case again in the last week of April but has refused to consider the plea for an interim release without waiting for ED's reply.

SC bench of Justices Sanjiv Khanna and Dipankar Datta heard the matter today.

Further, the Delhi Rouse Avenue Court today extended his judicial custody till April 23. He is remanded at Tihar Jail in an excise policy-related money laundering case.

Singh accused authorities of "inhuman" behaviour and said that "even the dreaded criminals are allowed to meet in the barrack". "When the wife of Arvind Kejriwal applied to meet him, she was told that you cannot meet him face-to-face but through a jangla [window]. Why such inhuman behaviour...," Singh said during a press conference on Saturday.

ANI reported that Advocate Rishikesh Kumar, counsel for Delhi CM said that the order is amenable for a challenge in the Supreme Court and they are within their rights to challenge it. As reported by ANI, Kumar, said, “We have challenged the illegal arrest of Arvind Kejriwal. The High Court in its finding has said that the remand order is legal and secondly, they said that they had the ground to arrest. This was the findings of the High Court in today's decision. Because the order is amenable for a challenge in the Supreme Court so we are waiting for the order to come. Once the detailed order is uploaded, we will challenge it before the Supreme Court as early as possible."

Arvind Kejriwal Supreme Court Hearing Live: What did Delhi HC say while rejecting plea?

The Delhi HC bench of Justice Swarna Kanta Sharma said, the ED had enough material, which led them to arrest Kejriwal, adding that his refusal to join the investigation when summoned and the delay caused were impacting those in judicial custody. 

"The accused has been arrested and his arrest and remand have to be examined as per law and not as per the timing of elections. Kejriwal's challenge to the timing of arrest before General elections in the absence of any mala fide on the part of ED is not sustainable," the court said. 

Evidence gathered by the ED indicates that Kejriwal participated in a conspiracy and actively engaged in utilizing and concealing proceeds of crime. The ED investigation also suggests his involvement both personally and in his capacity as the convenor of the AAP, the HC said.

Delhi CM Arvind Kejriwal while filing an appeal in the SC stated that his arrest was made in a “motivated manner" in the middle of the election cycle. His plea mentioned that that arrest was made after the declaration of the Lok Sabha 2024 election schedule. Seeking urgent intervention from the apex court he says it is an issue of illegal curtailment of liberty. Calling Arvind Kejriwal's arrest an “unprecedented assault on the tenets of democracy" based on “free and fair elections" and “federalism", the petition seeks the release of Delhi CM from jail. With the arrest, the ED has let its process “be used and misused by vested interests" as an instrument of oppression to not only "invade the liberty of the political opponents" amid the general election 2024 of such vested interests but also “to tarnish their reputation and self-esteem," the plea states.
