Execution case to be given top priority: CJI on Nirbhaya convict's mercy plea

The execution of death sentence for the four convicts in the Nirbhaya case has been fixed for 1 February at 6 am

    While hearing an appeal against the rejection of mercy petition of Mukesh Kumar Singh, one of the convicts in the 2012 Delhi gangrape case, Chief Justice of India SA Bobde said, "Execution case will be given top priority."

    The counsel for Singh had mentioned the case for urgent listing. On 17 January, President Ram Nath Kovind had dismissed his mercy plea.

    An apex court bench also comprising Justice BR Gavai and Justice Surya Kant said, “If somebody is going to be hanged then nothing can be more urgent than this." The bench added that since the execution date is 1 February, it is a matter of top priority and asked Singh’s lawyer to approach the mentioning officer.

    The execution of death sentence for the four convicts in the case has been fixed for 1 February at 6 am.

    Singh had moved the mercy plea after the Supreme Court dismissed his curative petition against his conviction and death sentence. The apex court had also rejected the curative petition of another death row convict Akshay Kumar.

    The other two convicts, Pawan Gupta and Vinay Kumar Sharma, are yet to file curative petitions before the Supreme Court.

    On 16 December 2012, a 23-year-old woman was brutally assaulted and raped by six persons in a moving bus in south Delhi, an incident which prompted nationwide protests. She died from her injuries on 29 December at Mount Elizabeth Hospital in Singapore.
