NEW DELHI : The Peace Party on Tuesday moved Supreme Court with a curative petition challenging the dismissal of the review petition in the Ram Janmabhoomi-Babri Masjid land title dispute case.
Mohammad Ayub, representing the Peace Party, has submitted that he was not party to this dispute earlier.
On 12 December, a five-judge bench headed by Chief Justice S.A. Bobde and comprising Justice D.Y. Chandrachud, Ashok Bhushan, S. Abdul Nazeer and Sanjiv Khanna had dismissed all the 18 review petitions filed against its 9 November verdict in the land title dispute case.
As per the petitioners, the Archaeological Survey of India’s (ASI) report in the judgment is a mere opinion which doesn’t corroborate that remains below the Mosque's structure were those of a Hindu Temple. The petitioners claim that even if a Hindu structure existed, the parties have not established that such a right over title was recognized.
In its 9 November verdict, a five-judge bench of the apex court had unanimously pronounced its verdict, asking the Centre to set up a trust, which would eventually pave the way for the construction of a temple where the 16th century Babri Masjid in Ayodhya.
The mosque was razed by a Hindu mob on 6 December 1992. The court had also said that 5 acres of land should be allotted to Muslims for the construction of a mosque in Ayodhya.
The top court had also ordered the government to set up the trust within three months. Nirmohi Akhara, one of the three litigants in the case, could be given representation in the trust if the Centre accepted the proposal, the bench had added.
