New Delhi: The Supreme Court on Monday issued notice to Uttar Pradesh government on a plea challenging the 2018 order which changed the name of the city from Allahabad to Prayagraj.
The special leave petition was filed by Allahabad Heritage Society and some residents of Allahabad after the writ petition was dismissed by Allahabad high court.
“The present Special Leave Petition raises substantial questions of law of general public importance in respect of the power of the Union and the State Government to change the name of places having historical significance as well as the scope of the right to culture under the Indian Constitution,” the petition reads.
“In the present case, the Respondent State Government has not cited any administrative reasons for the change of name of the district of Allahabad but has instead stated that the name of the district was allegedly Prayag but was changed to Allahabad. Therefore, the action of the Respondent State Government does not fall within the purview of Section 6(2) of the Revenue Code. Therefore, the exercise of power under Section 6(2) of Revenue Code to effect such a change is illegal and must be set aside….As submitted above, no entry in the State List or Concurrent List of Schedule VII of the Constitution expressly or impliedly grants the State Government the power to change the name of a place for reasons non-administrative reasons. Thus, the UP Revenue Code cannot be interpreted to empower the State Government to unilaterally change names of revenue areas for non-administrative reasons. The competence to effect such a change implied rests with the Union Government,” it further added.
The Allahabad high court had dismissed the plea last year.
The Centre had on 1 January last year approved renaming of Allahabad as Prayagraj.
