NCP Vs NCP: Maharashtra Assembly Speaker dismisses plea to disqualify MLAs of Ajit Pawar's faction

Pawar Vs Pawar: Maharashtra Speaker Rahul Narwekar reiterated that Ajit Pawar-led group was the real Nationalist Congress Party (NCP) when two factions emerged in the party in July 2023.

Maharashtra Assembly Speaker Rahul Narwekar dismissed disqualification petition against the MLAs of Ajit Pawar's and Sharad Pawar's faction. "All the petitions seeking disqualification of MLAs are rejected," Narwekar further said.

“...respondent cannot be disqualified as Ajit Pawar faction constituted the will of the party. They cannot be disqualified and the petitions against them liable to be dismissed," the Maharashtra Assembly Speaker said.  "Respondents (Sharad Pawar faction) are not liable to be disqualified. These petitions are dismissed," he added.

Narwekar was reading out his ruling on disqualification petitions filed by the warring factions led by Deputy Chief Minister Ajit Pawar and his uncle Sharad Pawar on Thursday evening.

The disqualification petitions were filed by the rival factions led by Sharad Pawar and his nephew Ajit Pawar after Ajit Pawar joined the Shiv Sena-BJP government in Maharashtra in July 2023 along with his followers, and was sworn in as Maharashtra's Deputy Chief Minister.

Ajit Pawar's faction ‘real NCP’

The Maharashtra Speaker reiterated that Ajit Pawar-led group was the real Nationalist Congress Party (NCP) when two factions emerged in the party in July 2023. He said the decision of Ajit Pawar faction constituted "will of NCP political party".

“Ajit Pawar had support of 31 MLAs is not disputed and they outnumbered the Sharad Pawar faction. Number of disqualification petitions filed show the strength of the factions," Narwekar said.

He added, “Ajit pawar faction had overwhelming legislative majority when split happened. This faction is the real NCP political party for these proceedings."

On charges of defection

On defection charges against Ajit Pawar's faction MLAs, the Speaker said, “None of the averments fall within 10th schedule. 10th Schedule is meant to prohibit defections while protecting democracy…."

Ruleing that it was not defection, the Speaker said Ajit Pawar and others' actions and statements between June 30 and July 2 last year were intra-party dissent. He, however, noted that the "misuse of provisions of constitution's 10th schedule by political parties was apparent in NCP case".

The Speaker noted that political parties and “leaders in a kaleidoscope" are “forging and forming new alliances, it is the reality of politics today and cannot constitute defection".

Narwekar's ruling followed the decision of the Election Commission last week to hold the Ajit Pawar-led party to be the real NCP.

Reacting to the Speaker's decision, Supriya Sule, MP of the NCP - Sharadchandra Pawar party, said it was a "copy-paste" of Narwekar's earlier decision in the Shiv Sena disqualification case.
