SC adjourns to Wednesday hearing independent Karnataka legislators’ plea

The plea said since the trust vote was not being conducted, the Karnataka government has benefitted from the logjam

    The Supreme Court has adjourned to Wednesday hearing in the plea of two independent legislators of the Karnataka assembly seeking direction to the Speaker to forthwith conduct the floor-test in the House by 5 PM today.

    The plea was filed by independent MLA R Shankar, representing the Ranebennuru constituency, and MLA Nagesh, representing Mulabagilu constitutency. The MLAs, who withdrew support to the Congress-JD(S) government in Karnataka, had moved the top court saying the state has plunged into a political crisis after they withdrew their support to the government and as 16 lawmakers of the coalition tendered their resignations.

    The plea said since the trust vote was not being conducted, the Karnataka government, which does not have the confidence of the majority, has benefitted from the logjam and has taken executive decisions like transferring police officers, administrative officers etc.

    It also alleged that Chief Minister H D Kumaraswamy may use medical emergency, including hospitalisation, to delay the trust vote further.

    The top court on Tuesday also took note of the submissions of Karnataka Assembly Speaker K R Ramesh Kumar that voting on the trust motion moved by Kumaraswamy is likely to be concluded by this evening.

    Senior Advocate Abhishek Manu Singhvi appearing for Kumar submitted before the court that he was “optimistic" that the floor test shall be concluded today.

    "I hope Speaker KR Ramesh Kumar realises what his position is, what the constitution has obliged him to do and the fact that the floor test is being adjourned day after day. If floor test is not held today, we will press for an operative direction tomorrow," said senior advocate Mukul Rohatgi while addressing the media outside the Supreme Court today.
